Content | The course covers the most important issues of arbitration such as the basic principles, the arbitration agreement and the tribunal's jurisdiction, the arbitral tribunal, the arbitral procedure, the arbitral award, setting aside proceedings and the recognition and the enforcement of arbitral awards. The focus is on international arbitration as it is practiced in Switzerland. The course follows the textbook "International Arbitration – Comparative and Swiss Perspectives", DANIEL GIRSBERGER/NATHALIE VOSER, Schulthess. The textbook will appear in its 4th and extended edition in the 2n half of March 2021 and thus the students should not buy the 3rd edition (from 2016). Students attending the lecture will be handed out a "Hörerschein" allowing them to purchase the book with a 20% discount. A syllabus with a reading list will be available on the website before the lecture starts. The readings listed for each class are compulsory. In addition, the students will be asked to make a short presentation about one case of the Swiss Federal Supreme Court. The legal materials mentioned in the syllabus and case law are to be researched by the students themselves. To this end, it is recommended to conduct research on the websites of the federal authorities of the Swiss Confederation (www.admin.ch) and the Federal Tribunal (www.bger.ch) or Weblaw (www.weblaw.ch). |
Learning objectives | At the end of this lecture each participant should know and understand the principles of domestic and international arbitration in Switzerland, including investment treaty arbitration and sports arbitration. The lecture is the ideal basis for the participation at the Willem C. Vis Moot Court, which takes place every spring in Vienna and Hong Kong. |

Comments | This course reflects the importance of international arbitration in today's international business world. Since international arbitration procedures are to a great majority conducted in English, this course will be held in English. Falls möglich wird die Veranstaltung nach Ostern wieder als Präsenzveranstaltungen durchgeführt, je nach Pandemiesituation und Vorgaben der Universität. Die Hörerscheine zum vergünstigten Bezug der neuen Ausgabe des Buches "International Arbitration - Comparative and Swiss Perspectives" (4th Edition) können bereits vor der ersten Vorlesung bezogen werden.
