15475-01 - Vorlesung: Schiedsgerichtsbarkeit 6 KP

Semester Frühjahrsemester 2015
Angebotsmuster Jedes 3. Semester
Dozierende Nathalie Voser (nathalie.voser@unibas.ch, BeurteilerIn)
Inhalt The course covers the most important issues of arbitration such as the basic principles, the arbitration agreement and the tribunal's jurisdiction, the arbitral tribunal, the arbitral procedure, the arbitral award, setting aside proceedings and the recognition and the enforcement of arbitral awards. The focus is on international arbitration as it is practiced in Switzerland. The course follows the textbook "International Arbitration in Switzerland", DANIEL GIRSBERGER/NATHALIE VOSER, literaB, 2nd edition, Schulthess 2012. The practical case in this book will be discussed and analyzed to illustrate central issues in arbitration.
A syllabus with a reading list will be available on the website. The readings listed for each class are compulsory. In addition, the students will be asked to make a short presentation about one item on the reading list, in particular a case of the Swiss Federal Supreme Court.
The journal articles listed in the syllabus are available for download. The legal materials and case law are to be researched by the students themselves. To this end, it is recommended to conduct research on the websites of the federal authorities of the Swiss Confederation (www.admin.ch) and the Federal Tribunal (www.bger.ch) or Weblaw (www.weblaw.ch).
Lernziele At the end of this lecture each participant should know and understand the principles of domestic and international commercial arbitration in Switzerland. Participants should be able to represent parties in an arbitral procedure. The lecture is also an ideal basis for the participation at the Willem C. Vis Moot Court, which takes place every spring in Vienna and Hong Kong.
