| Inhalt | In this class, students are introduced to English and American tort law through the study and analysis of decisions spanning from snails in beer bottles to asbestos-related mesothelioma (a type of lung cancer). Students are also introduced to the characteristics of Anglo-American case law, the English and American court systems and procedural peculiarities such as the jury trial and class actions. The course has different goals: First, to provide law students with a basic knowledge of Anglo-American tort law; second, to encourage them to "look beyond the border" of the Swiss legal system and discover the exciting things that lie beyond; and third, to provide students with the opportunity to speak English in a legal context and to gain confidence in their oral skills. By studying case law and discussing cases in class, we will find out about fundamental principles of tort law in common law systems. Students will be expected to prepare for class in advance and to participate actively in class. |
| Literatur | The class is based on C. Widmers book A Civil Lawyers Introduction to Anglo-American Law: Torts, Stämpfli 2008, which is available in bookshops. Hörerscheine entitling students to a 20%-discount will be distributed in class. |
