| Inhalt | The aim of this course is to introduce students to law and society approaches in social anthropology, law and broader social science disciplines. We will focus on approaches that go beyond a doctrinal approach to examine how law is, in Geertz’s formulation, both a model of society and for society. To what degree is law a culture itself, and what happens when claims are made in the language of culture in the courts? Law is embedded in social inequalities of race and gender and can both administer and reproduce those inequalities, and occasionally overturn them. Colonialism ruled through law as much as raw coercion and left a legacy of legal pluralism that complicates the administration of law to this day. The globalization of law spans the spectrum from commercial contracts to human rights, and the language of law is one of the common currencies of international governance. The course will conclude with a discussion of the legal and quasi-legal efforts undertaken by successor regimes to provide remedy to victims of human rights abuses. |

| Bemerkungen | This course will be taught in English. Proseminararbeiten / semester papers can be written either in English or German. Ideally, students attend the two proseminars "Humanitarianism" (by Rita Kesselring) and "Introduction to Legal Anthropology" offered by the Seminar of Social Anthropology since the two proseminars will relate to each other. The attendance of both proseminars together is not mandatory though. |

| Hinweise zur Leistungsüberprüfung | In order to receive credit points the participants will: - Read one text per week - Write two short text analysis (chosen from the weekly texts read) - Participate actively in the proseminar and complete small exercises at home - Not miss more than three classes If students decide to write a semester paper (Proseminararbeit + 3 ECTS): - They should get in contact with the course instructor - Draft an exposé and write the semester paper (Proseminararbeit) according to the "Merkblatt zur Gestaltung von Hausarbeiten" (https://ethnologie.unibas.ch/studies/ba-ethnologie/) - Present their paper in the course |
