19032-01 - Moot-Court: European Law 6 KP

Inhalt The course focuses on the practical application of European Law. The students advice a client in a fictional case (European Law Moot Court 2020/2021) and draft their arguments in written pleadings for proceedings in front of the European Court of Justice.
Working in groups, seminar participants will in an intensive effort write the two pleadings of 15 pages each that will be submitted to the current “European Law Moot Court” (ELMC) competition. Deadline for submissions is Wednesday, Nov. 25th 2020.
Furthermore, out of the seminar participants the best suited and motivated students are selected to participate in the “European Law Moot Court Competition” (ELMC). A maximum number of four participants will have the opportunity to register as the team representing the University of Basel in the ELMC competition. Based on the written submissions, the team may qualify for participation in the oral regional finals of the ELMC in early 2021. Should the four team members qualify for such an oral round, their additional work associated with preparing for the regional finals will be rewarded with an additional 3 KP (learning contract).
Lernziele Participants are able to research EU law and work intensively and effectively in groups on a fictional case. Development of skills to author a convincingly structured and formally correct legal submission within a tight timeframe. Participants gain confidence in presenting and defending their legal arguments in written and spoken presentations.
Literatur - The Moot Court case, upon which the course is based, is due to be published on 1st September 2020 under www.europeanlawmootcourt.eu.
- Other materials will be discussed and partly distributed in class and uploaded on the ADAM-server.
- Own research to Case Law and to legal background is required.
Bemerkungen Some French skills also welcome for creation of requested French résumés of submitted pleadings.

Teilnahmebedingungen The seminar seeks to involve law students (BA 5th semester and up) or students of the MA in European Global Studies that attended courses “Introduction to EU Law” (Tobler/Meyer) or “Völker- und Europarecht” (Breitenmoser/Petrig).
