| Inhalt | Nowadays, the use of digital services is indispensable from daily activity of business or end users. Digital services and online platforms in particular have contributed to the internal market by opening new business opportunities, increased consumer choice and competitiveness of industry. At the same time, these ‘gatekeepers’, which control a large digital market, are likely to lead to unfair practices and conditions for business users as well as for the end. This seminar focuses on the interplay between EU Competition law and conducts by certain tech companies in the digital markets, including the key role of the so-called “gatekeepers” who may prevent or enhance the free flow of information in the digital single market. The seminar will discuss the most recent developments concerning the Digital Markets Act and competition issues. To address these concerns, on 24 March 2022, the European Parliament and the Council, acting under ordinary legislative procedure, adopted the most important Regulation on contestable and fair markets in the digital sector, known as the Digital Markets Act (DMA). The seminar will also touch recent or on-going cases of NCAs at EU Member States against potential “gatekeepers”. |
| Lernziele | At the end of this course the student will be able: 1. to understand the basic of EU competition law and its relation with Tech Companies; 2. to understand the rationale and the necessity for regulation of the digital technology development in the digital market; 3. to understand the enforcement of Digital Markets Act and the compliance with competition law; 4. to understand different rights and obligations that different digital market actors may derive from EU Competition rules; 5. to understand on how certain actors impact the digital markets and to what extent as well as how precisely competition rules may prevent that such impact occurs abusive; and 6. to understand whether the Commission and NCAs of EU Member States have appropriate tools to address development of new technologies. |
