Inhalt | The course covers the most important issues of arbitration such as the basic principles, the arbitration agreement and the jurisdiction of the arbitral tribunal, the arbitral tribunal, the arbitral procedure, the arbitral award, setting aside proceedings and the recognition and the enforcement of arbitral awards. The focus is on international arbitration as it is practiced in Switzerland. The course follows the textbook "International Arbitration in Switzerland", DANIEL GIRSBERGER/NATHALIE VOSER, literaB, 2nd edition, Schulthess 2012 (Date of Publication: 16 February 2012), and will also resolve the practical case in this textbook. A syllabus with a reading list will be available on the website. The reading of the documents mentioned on the reading list for each week is compulsory. The journal articles listed in the syllabus are available for download. The legal materials and case law are to be researched by the students themselves. To this end, it is recommended to conduct research on the websites of the federal authorities of the Swiss Confederation (www.admin.ch) and the Federal Tribunal (www.bger.ch) or Weblaw (www.weblaw.ch). You can use your webmail account to access these websites. |
Lernziele | At the end of this lecture each participant should be able to understand and know the principles of domestic and international commercial arbitration in Switzerland. Participants should be able to represent parties in an arbitral procedure. The lecture is also an ideal basis for the participation at the Willem C. Vis Moot Court which takes place every spring in Vienna and Hong Kong. |
