15475-01 - Vorlesung: Arbitration (6 KP)

Inhalt The course covers the most important issues of arbitration such as the basic principles, the arbitration agreement and the tribunal's jurisdiction, the arbitral tribunal, the arbitral procedure, the arbitral award, setting aside proceedings and the recognition and the enforcement of arbitral awards. The focus is on international arbitration as it is practiced in Switzerland.

The block lecture itself is divided into:

• First, there are four introductory lectures (each lasting four hours) that provide students with an overview of international arbitration.
• Next, there will be an excursion to Zurich, where we will visit a law firm with experience in arbitration as well as the Swiss Arbitration Center.
• Finally, students will engage in an in-depth study of a specific area of arbitration and present their findings, which will also serve as their assessment. The presentation will focus on a substantive topic or, alternatively, a detailed discussion of a case. Students will also prepare a written summary of their presentation, which will be taken into account in the evaluation.

The block lecture will (continue to) be held in English. Also the events during the excursion, and the oral presentations to be held by the students at the end of the lecture will be held in English.

Lernziele At the end of this lecture, each participant should know and understand the principles of domestic and international arbitration in Switzerland, including investment treaty arbitration and sports arbitration. The lecture is the ideal basis for the participation at the Willem C. Vis Moot Court, which takes place every spring in Vienna and Hong Kong.
Literatur The lecture is based on the following book: “International Arbitration- Comparative and Swiss Perspectives”, Daniel Girsberger/Nathalie Voser, 5th Edition, Schulthess 2024.

Bemerkungen An introductory event will take place on 21 May 2025.

Anmeldung zur Lehrveranstaltung The number of participants is limited to 18. In case of a higher number of interested students, those who did or will participate or intend to participate in the Vis Moot will be given preference. Once a student has been accepted, the participation at all events is required to obtain the credits.
