50902-01 - Lecture: International Sales Law (CISG) (6 CP)

Content The course provides an introduction into the United Nations Convention on Contracts for the International Sale of Goods of 1980 (also known as "CISG" or - in German - "UN-Kaufrecht"). This Convention is currently in force in 95 States throughout the world (among them Switzerland, 25 of the 27 EU Member States, Australia, Brazil, Canada, China, Japan, Singapore, Ukraine, the U.S. and many others). The provisions of the CISG potentially apply to more than 80% of cross-border sales world-wide; where they apply, they displace provisions of domestic sales law (like Arts. 197 et seq. OR.)

During the course, the students learn about the applicability of the Convention and its rules on contract formation as well as the rights and obligations of buyers and sellers. The course includes case studies based on CISG cases decided by Swiss and foreign courts as well as contract drafting exercises.

The course is taught in English because Swiss-trained lawyers very often have to apply, explain or argue the CISG in English when dealing with CISG cases in practice. It therefore makes sense for students to study the Sales Convention in English.
