67345-01 - Seminar: Comparative Legal Analysis in Bioethics 1 CP

Content Considering how well-developed research in the legal domain is, there is relatively little reflection on the methodological underpinnings of legal analysis. In this short seminar, one specific methodological approach to doing (comparative) legal analysis will be developed, with a particular attention to legal topics within the bioethical domain. The course will start with an epistemological reflection on the nature of law (focusing on the question “what is law?”), to then illustrate a methodological approach for the legal field (focusing on the question “what is legal analysis?”), to finally discuss some practical exercises of how this can be used to analyze the legal implications of problems in the bioethical (including ethical issues in public health) domain.
Learning objectives Students will be equipped with the basics on how to do (comparative) legal analysis in the biomedical domain, and in particular with three concrete methodological instruments to utilize in investigating the law in a topic of interest.
