67893-01 - Lecture: Seerecht 6 CP

Content The course starts with an introduction into the foundational ideas of the law of the sea and a presentation of the United Nations Convention on the Law of the Sea (UNCLOS), which is dubbed as the “Constitution for the Oceans”. In a next step, students are acquainted with the zonal approach and the different maritime zones while a distinction is drawn between zones under and beyond national jurisdiction. What follows are lectures dedicated to various activities at sea, notably maritime security and law enforcement at sea, migration at sea, climate change and the oceans, protection of the environment, biodiversity and plastic pollution and human rights at sea. The course concludes with an overview of the UNCLOS dispute settlement.
Learning objectives By the end of this course, students understand the foundational ideas and general concepts of the law of the sea and are able to apply this knowledge to practical cases and scenarios.

The course is taught in English. The reasons for this are manifold. Most importantly, a great many sources are only available in English (and some other UN languages), Swiss-trained lawyers who will be working in the field of the law of the sea will most certainly apply and argue the law of the sea in English, and invited guest speakers will be lecturing in English. However, each student can choose to sit the oral exam in English or in German (or a mixture of it).

 

Admission requirements Prior attendance of the lecture "international law" ("Völkerrecht") is an asset but not a prerequisite.
